These Terms of Service ("Terms") are a binding agreement between you (and, if you are registering on behalf of a company, that company) and the operator of DNC Boss ("we," "us," "the Service"). By creating an account, checking the box at registration, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not register for or use the Service.
You must be at least 18 years old and able to form a binding contract to use the Service. If you register on behalf of a company, you represent that you are authorized to bind that company to these Terms, and "you" in these Terms refers to that company as well as the individual account holder.
DNC Boss provides tools to check phone numbers against a Do Not Call ("DNC") dataset loaded onto the platform, via single-number search, bulk file upload, and a REST API. The Service reports whether a number appears in the currently loaded dataset — it does not, by itself, determine whether it is lawful to call that number.
Results returned by the Service reflect only the dataset loaded at the time of the check. A "no match" result is not a representation that a number is safe to call, and does not account for state-specific do-not-call registries not loaded on the platform, internal do-not-call requests made directly to you, consent requirements, litigator lists, reassigned-number status, or dataset updates that occur after a check is performed. Nothing in the Service constitutes legal advice. You are solely responsible for your own compliance with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), state telemarketing and do-not-call laws, and all other applicable federal, state, and local law. You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of your password and API keys, and for all activity that occurs under your account, whether by you or by a team member you or your company admin has added. Notify us immediately of any unauthorized use of your account.
Subscription plans, usage limits, and pricing are set by the platform operator and may change; the terms currently applicable to your account are shown in your dashboard. Fees are billed in advance for each billing period and are non-refundable except as required by law or as we expressly state otherwise. Non-payment may result in suspension of access. Usage beyond your plan's limits may be blocked, throttled, or billed as overage depending on your plan.

You retain ownership of the phone number lists and other data you upload. We process this data to provide the Service to you and do not sell it. See our Privacy Policy for details on what we collect and how it's used.
The underlying DNC dataset, and the Service itself (including its software, design, and documentation), are owned by us or our licensors and are provided for your use within the Service only under a limited, non-exclusive, non-transferable license. You may not extract, export, republish, or redistribute the raw dataset, except for the results explicitly provided to you for numbers you checked. All trademarks, logos, and brand elements associated with the Service remain our property.
The Service relies on third-party providers to operate — for example, infrastructure hosting, transactional email delivery, and (if applicable to your plan) payment processing. Your use of features that depend on these providers is also subject to their respective terms, to the extent disclosed to you.
We may suspend or terminate your account for violation of these Terms, non-payment, suspected fraud or abuse, or as otherwise described in your subscription plan, with or without notice where circumstances reasonably require it. You may cancel your subscription at any time from your billing page. Sections of these Terms that by their nature should survive termination (including Sections 4, 9, 12, 13, 14, and 15) will survive.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT THE DNC DATASET IS COMPLETE OR CURRENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY REGULATORY FINES, PENALTIES, OR THIRD-PARTY CLAIMS ARISING FROM CALLS YOU MAKE USING RESULTS FROM THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right, including claims arising from calls you make in reliance on results from the Service.
These Terms are governed by the laws of the jurisdiction in which the operating entity is organized, without regard to conflict-of-laws principles, unless a different jurisdiction is required by applicable consumer-protection law. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. We will not be liable for delays or failures caused by events beyond our reasonable control. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above, and, where required by law, we will provide additional notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
